These Terms of Service (hereinafter referred to as "Terms") set forth the conditions for using Tool Garden (hereinafter referred to as "Service"). All users (hereinafter referred to as "Users") shall use the Service in accordance with these Terms.
Article 1 (Application)
1. These Terms shall apply to all relationships between Users and the operator of this service (hereinafter referred to as the "Operator") regarding the use of the Service.
2. The operator may establish various rules and regulations regarding the use of the Service in addition to these Terms (hereinafter referred to as "Individual Provisions"). These Individual Provisions, regardless of their name, shall constitute a part of these Terms.
3. In the event of any conflict between the provisions of these Terms and the Individual Provisions, the Individual Provisions shall prevail unless otherwise specified in the Individual Provisions.
Article 2 (Prohibited Activities)
Users shall not engage in the following activities when using the Service:
1. Activities that violate laws or public order and morals
2. Activities related to criminal acts
3. Activities that may interfere with the operation of the Service
4. Activities that cause inconvenience to other users
5. Collecting or accumulating personal information about other users
6. Unauthorized access or attempts thereof
7. Impersonating other users
8. Activities that directly or indirectly provide benefits to antisocial forces in connection with the Service
9. Any other activities deemed inappropriate by the operator
Article 3 (Intellectual Property Rights)
1. All intellectual property rights (copyrights, trademark rights, design rights, etc.) related to the Service belong to the operator or third parties with legitimate rights.
2. Users may freely copy, modify, and use documents generated using the Service within the scope of private use or use in their own business operations.
Article 4 (Disclaimer)
1. The operator does not explicitly or implicitly guarantee that the Service is free from defects in fact or law (including defects related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, infringement of rights, etc.).
2. The operator shall not be liable for any damages incurred by Users arising from the Service, except in cases of intentional or gross negligence on the part of the operator.
3. The operator shall not be liable for any transactions, communications, or disputes between Users and other users or third parties regarding the Service.
Article 5 (Changes to Terms)
The operator may change these Terms at any time without notice to Users when deemed necessary. If a User begins using the Service after the Terms have been changed, the User shall be deemed to have agreed to the revised Terms.
Article 6 (Changes to Service Content)
The operator may change the content of the Service or discontinue the provision of the Service without notice to Users, and shall not be liable for any damages incurred by Users as a result.
Article 7 (Governing Law and Jurisdiction)
These Terms shall be interpreted in accordance with Japanese law. In the event of any dispute regarding the Service, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.
